Archiving of Data

 Information pertaining to you and your use of the Site may be archived after a period of two (2) years. Your use of the Site hereby constitutes your agreement with the archiving of such material.

Utilyx reserves the right, in its sole discretion, to terminate your access to all or part of any of our Site, with or without notice.

Security

We employ appropriate technical security measures to protect your personal information and ensure that it is not accessed by unauthorised persons. Data is held on secure servers in an access controlled secure environment, and is encrypted wherever possible. Our security procedures also provide that we may request proof of identification before we will release personal information to you. We undergo periodic reviews of our security policies and procedures to ensure that Utilyx systems are secure and protected.

The Bribery Act

At Utilyx, we commit to applying consistently the letter and spirit of applicable anti-bribery legislation in all markets and jurisdictions in which we operate.  Our zero tolerance policy with respect to the giving or receiving of bribes is clearly communicated to all employees and relevant third parties.
Specifically, Utilyx’s anti-bribery policy prohibits employees, agents, other intermediaries, joint ventures, contractors and suppliers from directly or indirectly, offering, promising or receiving any bribe, financial or other advantage, making any payment or transfer for value, or any other inducement in any form, which has the purpose or effect of public or commercial bribery. 

We also prohibit acceptance of, or acquiescence in, bribery, facilitation payments or other unlawful or unethical means of obtaining or retaining any business or commercial advantage or bringing about the improper performance of any person’s business or public function or activity.  This prohibition applies to third parties who are retained to perform services or conduct business for and on behalf of Utilyx group, or those conducting business together with Utilyx group.


We require all employees and third parties to comply with the following principles in the performance of their services for on behalf of the Utilyx group:
All forms of bribery are prohibited whether they take place directly or indirectly through another party.


Funds, property or facilities of the Utilyx group will not be used to provide support for, or contribute to, any political organisation, or candidate.
Charitable contributions and sponsorship will not be utilised without senior management agreement.
We maintain a Gifts & Hospitality policy which is closely monitored.

Anti-Bribery Policy

The Bribery Act 2010 introduces the corporate offence of failing to prevent bribery which carries an unlimited fine. As a company we are committed to ensuring we have a culture where bribery is unacceptable within the company. Our integrity and ethical values are at the heart of everything we do and we will not allow our employees to give or receive bribes. This policy extends to all the company’s business dealings and transactions in all countries in which it and its associates operate.

The following are all unacceptable and will be treated under the Bribery Act as criminal offences:

• A general offence covering offering, promising or giving a bribe;

• A general offence covering requesting, agreeing to receive or accepting a bribe;

• A separate offence of bribing a foreign official to obtain or retain business;

• A strict liability offence for companies that fail to prevent bribery by those acting on their behalf.

All the offences above will be treated as a criminal offence.

Code of Conduct

Utilyx has a strong commitment to business integrity and we prohibit our employees from soliciting, arranging or accepting bribes intended for the employees or company’s benefit or that of the employee’s family, friends, associates or acquaintances.

It is also our policy that we work to ensure that our agents and other intermediaries, joint ventures, contractors and suppliers do not make facilitation payments on our behalf.

Utilyx is committed to encouraging the implementation of an anti-bribery programme equivalent to its own in entities with which we have significant business relationships.
